Employee Dispute Insurance & Advice

Protecting your business against the cost of employment tribunals, legal fees, settlements and awards
SA Law Employment Laptop

When you are in a dispute with an employee, the last thing you want to be worrying about is ‘what is this going to cost me’?

Most employers will find themselves managing a dispute with an employee at some stage. It is usually best to try and resolve disputes before they result in an employee making a claim. Where that’s not possible, employment protection insurance will limit the impact on your business.

The insurance protects you against the cost of employment claims in three ways.

Firstly, it covers the cost of legal representation and advice in connection with the dispute. This means you can get the help you need to respond effectively to the claims made against you, without worrying about the costs. Secondly, if the worst comes to the worst and you are found liable for any compensation in an employment tribunal, the insurance policy would pay any such sums. Finally, if you are minded to try to settle the claim, the policy would also contribute towards the settlement sum.

Unusually for this type of insurance, legal fees are covered from the point at which the compulsory ACAS pre-claim conciliation process starts (before the claim is issued in tribunal). This means that, if you prefer to settle the dispute, the insurer will pay for the cost of advice to help you negotiate a settlement much sooner in the process than many similar types of cover.

The insurance works alongside our Employer Protection Scheme. The scheme provides a compliance audit of your employment contracts and HR policies and procedures as well as employment law advice whenever you need it. With this level of support, you can be confident that you will have the guidance you need to protect your business against the financial and reputational risks of employee disputes.

Optional insurance cover is also available to cover the legal costs of:

  • High Court proceedings to enforce post-termination restrictive covenants and obtain injunctive relief.
  • Defending prosecutions under the Health and Safety legislation.
