Injury to Feelings: Vento Bands Increased

The President of the Employment Tribunals has confirmed an increase in the compensation bands (known as Vento bands) awarded for injury to feeling in discrimination cases. This is an award of damages aimed as a remedy for the degradation suffered by employees and is considered separately from any claim for financial loss, such as loss of earnings.

Tribunals have discretion as to what to award but they will take into account these Vento bands.

Employment Tribunal awards for injury to feelings, in respect of claims presented on or after 6 April 2024, will be increased as follows:

  • A lower band of £1,200 to £11,700 for less serious cases;
  • A middle band of £11,700 to £35,200 for cases that do not merit an award in the upper band; and
  • An upper band of £35,200 to £58,700 for the most serious cases, with the most exceptional cases capable of exceeding £58,700.
