We previously reported that following the Supreme Court’s decision that the Employment Tribunal (ET) fee regime was unlawful, the Government had announced its intention to refund any fees paid under the regime.
Following a pilot scheme in October, the Government has this week announced that the ET fee refund scheme is fully open for applications. It’s estimated that the scheme (including interest) will cost £33 million.

Refunds are available to anyone who made a claim and paid the ET fee personally, to those who paid the fees on someone else’s behalf (eg a union), or companies whom the ET ordered to pay fees of someone who brought a claim against them.
The majority of individuals will simply need to complete an online form, with the refund then credited to their bank account (with interest calculated at 0.5%).
