EXPERTISE
I advise residential and commercial property owners, investors and developers on a wide range of complex issues with a view to avoiding disputes where possible. I also help clients to navigate around and find practical solutions to resolve disputes when they arise.
I cover a broad spectrum of property matters including residential and commercial landlord and tenant, possession claims (including claims against tenants, occupiers, squatters), adverse possession, rent and service charge recovery, breaches of lease and commercial and residential statutory lease renewals.
I frequently work with developers, freeholders, landlords and leaseholders in connection with development disputes. This includes advising on airspace and rooftop development, party wall and boundary disputes, as well as right-to-light, for both claimants and defendants.
I work closely with the firm’s Real Estate team on many types of property matters. In particular I advise on issues relating to option and overage agreements and taking steps to secure vacant possession of commercial units and warehouses for redevelopment.
KEY EXPERIENCE
- Advised a developer on the feasibility of roof top development which included issues relating to residential leaseholders, restrictive covenants and party wall matters.
- Advised a residential freehold company in relation to rooftop development as a means to fund an extensive service charge project. Obtained determination at the First-tier Tribunal (Property Chamber) as to the extent of the freeholder’s rights, advised on the right to develop and on the legal challenges and issues, taking the client through to development stage.
- Acted for a client in relation to a claim pursuant to the Trusts of Land and Appointment of Trustees Act 1996 following a disagreement about a business agreement.
- Advised a developer in relation to an exit clause on an overage agreement.
- Acted for a commercial landlord in relation to a right to light claim against a large developer, securing a substantial damages settlement sum.
- Obtained an urgent interim injunction on behalf of a freeholder of a block of flats to prevent the leaseholders from obstructing planned major works and from holding themselves out as directors.
