Achieving a favourable judgement on a terminated contract

Strong evidence at adjudication resolved a complex £15 million maintenance contract

Situation

A council-run organisation was forced to terminate a complex £15 million technical maintenance contract because the service provider failed to deliver as agreed. Disputing the termination, the service provider subsequently made a referral for adjudication. However, this was an extremely complex contract with a vast amount of documentation and data that was relevant to the case.

Solution

Our first step was to go through the documentation and data to understand the difference between the work that had been defined and the work that had actually been carried out. We represented the council-run organisation throughout the adjudication and subsequent Part 8 proceedings. On the strength of the evidence we uncovered, the adjudicator ultimately upheld our client’s decision to terminate the contract.
